The Singapore International Commercial Court (“SICC”) has jurisdiction to hear any proceedings relating to international commercial arbitration that the General Division of the High Court may hear under the International Arbitration Act 1994 (“IAA applications”).
Where proceedings under the International Arbitration Act 1994 are commenced in the General Division of the High Court, counsel should take instructions from their clients on the potential transfer of the proceedings from the General Division of the High Court to the SICC if: (a) none of the parties is from Singapore or, if there are three or more parties, not more than one party is from Singapore; and (b) the value of the subject matter in the underlying dispute or the amount of the arbitral award (whichever is less) is at least S$10 million.
The Rules governing IAA applications in the SICC may be found in Order 23 of the SICC Rules 2021. For more information, please refer to the SICC Procedural Guide and Arbitration Users Guide.
